- Here is the 14th Amendment, Section 1 of the US Constitution, word for word. Statements from groups opposed to gay marriage have recently used language like, "Love the sinner, hate the sin" and "We accept homosexual people as long as they do not practice the act of homosexuality" and even, "Gay people have Civil Unions, why do they need marriage?" These statements, whatever else you think of them politically, acknowledge gay people as part of the American community, as part of the same society as those who make them. Logically, this acknowledges gay people as American citizens. Therefore, the equal protection of the 14th Amendment must apply to the civil function of marriage, as practiced by the government and applied through government issued marriage licenses. whatever else one believes about marriage, it's definition, its sacredness, is completely open to competing or opposing definitions outside of a government context. But, if one class of Americans enjoys a right, a privilege bestowed by the government, then all classes must be awarded the same privilege. Prop 8 is the recently passed referendum defining marriage in the California state Constitution as "between one man and one woman", thus excluding gay marriages from State government recognition, services, and rights. D.O.M.A is the Federally passed law the Defense Of Marriage Act which also defines marriage as between one man and one woman, thus excluding gay marriages from Federal recognition, services and rights.
